Miamama’s Terms and Conditions
Miamama (“Miamama”, “we”, “us” or “our”) provides the services on this website.

These terms and conditions are a contract between us and you (the purchaser) and they must be read carefully. Miamama has the right to revise these terms and conditions at any given time. Any changes made will become effective immediately.

Miamama welcomes any comments or questions regarding our services and products. Our contact details are as follows:

Payment
Payment in full is required at the time of ordering a product or booking a baby yoga/ massage class. Payment can be made through PayPal. You will have to confirm that the account and cards you use for payment are yours or authorised to use. All debit/ credit cardholders are subject to validation and authorisation by the card issuer.

If there is a delay or any issues with payments for whatever reason, Miamama reserves the right to withhold/ refuse delivery of products until the payment is settled. Miamama will not reserve a place in any of the baby yoga/massage classes nor will we accept clothes for keepsakes that have not been paid for. Until payment is received in full, Miamama maintains ownership of any of their products and if a refund has been made, ownership will transfer back to us on receipt of the item (s). Miamama is under no obligation to inform you of the reason of refusal.

Furthermore Miamama takes no responsibility for any fees charged by your bank or card issuers for us processing your debit/credit card.

Price
The price displayed is in Pound Sterling and inclusive of VAT. The price does not include delivery unless otherwise stated. Delivery charges are specified on the relevant pages. Prices may change in accordance to trade prices and room hire.

Miamama reserves the right to correct any errors made on pricing displayed without prior warning. If the error results in the price being higher, Miamama reserves the right to contact you to discuss whether you want to continue with the sale, meaning you the purchaser will be required to pay the outstanding balance. However you will be given the option to cancel the order if you wish at this stage. If the error resulted in the product being lower in price, the assumption will be made that you want to continue with the order.

The price of the baby yoga course is for 5 weeks and includes the use of mats and weekly course handouts. The same for baby massage course but it also includes a bottle of 100% organic cold pressed sunflower massage oil.

Embroidery of name and date of birth on the keepsakes is included in the price but any extra personalisation or added photos will incur an additional charge. These additional charges along with the cost of postage and packaging will be displayed in the basket prior to checkout.

Upon successful completion of your order, you will receive an order number which you will be asked to keep a note of. A confirmation email will also be sent to you containing details of your order and order number. It is you (the purchaser’s) responsibility to take note of the reference number and to ensure your email address is correct at the time of ordering. Miamama will not be held responsible of any loss of these details.

Please note it is the responsibility of the purchaser to pay for any import charges for order placed out with the UK.

Placing an order
Miamama would prefer if all orders are made through this ecommerce site.

Booking and refunds:
We hope that you are satisfied with your purchase (s) from our website but if there is any reason that you are unhappy with any skincare purchases, Miamama will offer a refund on items which are returned within 30 days of dispatch as long as they are in their original, unopened condition. This does not affect your statutory rights.

When appropriate, you will be given the choice to exchange your product for another item within our site (the difference in price and postage must be paid) or a full refund, excluding postage, will be made. If you choose a refund, payment will be made back to the account it was paid from. Once we receive the product, you will be notified and payment will be made to the associated account soon after (this usually can take up to 14 working days).

Please note that sale items cannot be returned. For personal hygiene reasons, items such as lip gloss, deodorants or unsealed products cannot be returned unless they are faulty or if they have a seal which remains intact.

Please be advised that Miamama is under no obligation to provide refunds once a baby yoga or massage course has commenced. If you are unable to complete the full 5 week course for whatever reason, you will be offered an opportunity to attend these missed classes during a different scheduled course (depending on available spaces).

If the reason of missed classes was due to medical reasons for either the parent, carer or baby, a refund for the said classes will be granted with presentation of a note from the health professionals or health centre.

In the unlikely event that the instructor has to cancel a class and is unable to offer a suitable alternative day/time, a refund for that class will be given.

Concerning the keepsakes, as these are handmade, it is not possible to provide a refund unless the fault is due to a mistake on our behalf (incorrect spelling of a name for example).  In this situation you will be offered the opportunity for us to rectify the fault where possible.

Any unused items of clothing will be returned to the owner along with the keepsake. Any partially used items will not be returned.

Please remember these are bespoke handmade items, therefore each and every one is different from the other. Each keepsake is made from different materials and various colours which can cause the appearance to vary. Therefore no guarantee can be given that it will look identical to a previous keepsake made. Although the same pattern is used, the size stated in the description is only an approximate. This is due to using various fabrics, this can alter the size of the finished product. Most of the patterns used by Miamama are from Funky Friends Factory.

Colour of thread, ribbon and design choice will be made by Miamama unless requested otherwise. Therefore refunds will not be granted due to the colours or design used.

Product descriptions and information
Although we have made every effort to ensure that the colours of the products are as accurate as possible, variation can occur from one computer monitor to another.

Miamama does not take any responsibility for the manufacturers descriptions and ingredient contents of their products. The skincare descriptions and ingredient information have been provided by the product manufacturers.  Miamama has made every effort to ensure that the manufacturers have provided accurate information on their product lines. Miamama cannot be held responsible for inaccurate information provided by the manufacturers.

Due to the lack of artificial preservatives in the skincare products we can only guarantee a shelf life of 6 months from purchase.

Order cancellations
As we are dealing with handmade keepsakes, if you wish to cancel your order, please do so before sending us the items of clothing. A full refund will be made at this time. However if you decide to cancel your order after the items of clothing have been received by us and the keepsake is being made, a refund is not possible at this late stage.

Miamama is fully aware of how important these items are to you and we will treat them with the respect they deserve. If however you change your mind once the item is being created, Miamama cannot be held responsible for the items of clothing which have already been cut in preparation for the keepsake. Only the items that have not been altered will be returned if requested at the expense of the purchaser. Miamama cannot be held responsible for any items of clothing which have been mistakenly posted. It is the purchaser’s responsibility to check their items carefully before posting them to ensure no mistakes are made.

With regard to the skincare products, you are within your rights to cancel an order up to 7 days post receipt of goods. Your wish to cancel must be in writing and the goods must be returned at your own cost in the same condition, unopened and unused to the following address:

If you are returning a product that came with a free gift then this free gift must also be returned unopened and unused or you will be given the opportunity to purchase the gift at the given price within the website.

With regards to the baby yoga/ massage classes, you are able to cancel your place with a full refund up to 7 days prior to the course commencement date. With cancellations any less than 7 days, a £10 cancellation fee will apply. This is to cover the following cost of travel and room hire.

Class cancellations
The instructor will do their utmost to prevent any class cancellations however sometimes unforeseen circumstances arise which unfortunately no one has any control over such as sickness and safety to travel in certain weather conditions. In such circumstances, you will be notified by phone or via a text or email, so please ensure you provide an up to date phone number and email address. If there is any changes to your contact details during the course it is your responsibility to notify the instructor of these changes.

Before leaving your home to attend a class please always check your phone for any messages.

In the event of bad weather, if the instructor deems the weather conditions unsafe for travelling, you will be notified by the same means as above. This is for the overall safety of the parent or carer and baby.

The Miamama website will also be updated of any cancellations.

If a class is missed due to sickness of the instructor or due to adverse weather conditions, this will be made up at the end of the course (i.e. the course will run a week longer to make up for 1 cancelled class).

If however the instructor has deemed the weather fit for travelling, but you have taken the decision not to attend, you shall not be reimbursed.

Sickness of parent/ carer or baby
In the event that you or your baby are unwell or whether you are unsure if it is ok to attend a class, it is your responsibility to contact the instructor before leaving the house to attend the class. This is so the instructor can assess the risk to the other participants and advice you whether or not to attend the class.

If you or your baby has had vomiting and diarrhoea, please only attend the class if you have been clear of any symptoms for a minimum of 48 hours. This is for the safety and consideration of the other parents, carers and babies.

Please NEVER attend a class if your baby has chicken pox or either of you have conjunctivitis or any other infectious conditions. Again this is for the safety of the other participants.

It is the parents or carers responsibility to adhere to the above. Miamama cannot be held accountable for any lack of disclosure of the above. The instructor reserves the right to request the parent or carer to leave a class if they or their baby have been suffering from any of the above.

Time and venue alterations (relating to baby massage/yoga classes):
In the unlikely event that a class time or venue has to be altered after the course is booked, the instructor will do their very best to inform you as far in advance as possible. No refund will be offered if the time alteration is 30 minutes or less and if the venue is less than two miles from the previous arranged location.

Right to reject
Under the Consumer Rights Act you have a legal right to reject any goods which are unfit for the purpose intended, are unsatisfactory quality and not as described and have the right to a full refund within 30 days of buying the product. After the 30 days, you are no longer legally entitled to a refund if the product develops a fault.

If there is a fault with the keepsakes on receipt, it is the purchaser’s responsibility to inform us as soon as possible. Miamama will not be held responsible for any damage caused to the item after its receipt.

Sending your clothes
Miamama cannot be held responsible for any loss or damage of your items during their delivery to us. We would recommend that you send the parcel signed for, for that added reassurance.

The number of items required for the keepsakes is clearly detailed on the product description.  We ask that the clothes that you send are in reasonable good condition to work with. Miamama requests the right to refuse the use of items which are deemed unsuitable. Return postage of any unsuitable clothing will be the responsibility of the purchaser.

Delays in making the keepsakes.
Given the nature of these keepsakes and depending on the demand and the size of the order, only an approximate timeframe can be given at the time of placing your order. If we feel that we are going to run over the said time, the purchaser will be given the option of a full refund if they choose not to wait for their product to be made.

Delivery
Keepsakes will be sent via courier within 1-3 working days after completing the work.

After receiving your order, skincare products will be dispatched within 1-3 days via Royal Mail or via courier. If an order is placed on a non-working day, the order will be processed the following working day.

Due to the nature of the skincare products and the lack of artificial preservatives, large quantities of stock are not kept on our premises at any one time. Every effort will be made to ensure stock levels will be maintained. However if there is going to be a delay in dispatch due to a stock control problem, you will be notified as soon as possible with the expected date of delivery. You will be given the option of waiting for the product or cancelling the order.

Orders will be sent to the delivery address supplied at checkout. Therefore Miamama cannot be held responsible for incorrect addresses provided by the purchaser.

We are unable to deliver to PO Boxes.

Product liability
It is the purchaser’s responsibility to read all the product instructions carefully before use and to only use it in the manner it was purposefully designed for. Miamama will not be held responsible of damage, illness or injury caused by misuse of any product sold on this ecommerce site. Miamama will not be held responsible for any damage, illness or injury that may occur due to an allergic reaction or as the result of any other unexpected incidences.

Please note the stuffed animal keepsakes are not CE tested due to their bespoke composition therefore they are NOT designed or intended for use as a toy.  They are not designed or intended for use by children under the age of 14.  A home sewing machine is used in making these keepsakes with double stitching. Due to the detail on these keepsakes some sewing is done by hand. Safety eyes and noses are used if not sewn on. Buttons are used on the joints of the button bear and although the utmost care and attention is used, if these become loose, they pose a choking threat. The stuffing is 100% CE polyester. These keepsakes would not withstand play by children due to the materials used. Miamama therefore does not accept any liability for misuse of these bespoke keepsakes.

Miamama reserves the right to take photos of any finished keepsake to place on the photo gallery of their website and any social media sites.

Complaints
If you have any concerns or complaints regarding the service you have received, please contact Miamama for a complaints form and it will be dealt with appropriately. Your views and opinions are very important and will be handled with the utmost importance.

Photography and videos
To respect other parents/ carers and baby’s privacy, no photography will be allowed during these classes unless written consent has been provided from the instructor and every other parent or carer attending the class. The person taking the photo will be asked to also sign a disclaimer declaring that these photos will not be used on any social media site or any other website unless permission is granted by the other parents or carers and the instructor.

Under no circumstances are videos allowed to be taken during the classes.

If a person is suspected of taking pictures without the required consent or indeed videos, the instructor reserves the right to ask this person to leave the course without reimbursement.

Miamama will not be held responsible for any person in breach of regulations relating to photography and video.

Again in the interest of respecting people’s privacy, no observers will be allowed regardless of whether they are a friend or family member.

Personal property (concerning baby massage and yoga classes)
Miamama will not be held responsible for any loss or damage to any personal property whilst attending a class.

Health and Safety (issues relating to baby massage/yoga classes)
Please place your belongings in a neat and tidy location within the room so that it does not pose a hazard to others.

Please be respectful of other classes and do not enter the booked room until the previous class is finished.

Phones should be put on silent during the class to ensure a calm relaxed atmosphere.

Age restrictions
To take part in baby massage it is recommended to wait until after the 6 week postnatal check-up. For baby yoga it is recommended that baby is 16 weeks before participating. Both courses can be done until your child is crawling.

Class participation
Baby massage/ yoga will be performed on the floor using the mats supplied. The parent or carer will be expected to be able to kneel safely on the floor without any concerns to their physical health.

The class moves/ strokes is to be carried out by the individual parent or carer (i.e. not two people massaging at the same time).

The instructor will only demonstrate the moves/strokes on the demonstration baby. They will NEVER do any strokes or moves with a participating baby.

Exclusion of liability clause
With the lack of any proven carelessness, negligence or violation of the role as an instructor, participation of any parent, family member, carer or baby is done entirely at your or their own risk, therefore Miamama will not be held responsible.

Medical history
The importance of informing the instructor of any medical conditions needs to be highlighted here. It is the parent or carers responsibility to notify the instructor of any health conditions which may have any impact on them whilst they attend a baby yoga or massage course.

Where there is any medical conditions present, it is the parent or carers responsibility to seek medical advice and gain consent to participate, prior to booking a baby yoga or massage course.

Miamama will not be held responsible for any failure to adhere to the above.

Baby changing and nappy disposal
Please change baby in the provided changing facilities or on a suitable mat on the floor. Please dispose of nappies in the designated bins provided.
